Fitpole is an online store operated by UAB “Baltic Marine Spedition”, a company registered in Lithuania (company code 302622025, VAT number LT100006102019). References to “we”, “us”, and “our” in these Terms refer to the company operating the Fitpole store.

These Terms & Conditions govern your use of the Fitpole website and the purchase of products offered through our online store.
We reserve the right to update or modify these Terms & Conditions at any time. Any changes become effective immediately after publication on this page. The version in effect at the time you place an order will apply to that order.
3. Eligibility
By placing an order, you confirm that you are at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering into a binding contract.
4. Products
We make every effort to display our products, colors, sizes, and descriptions as accurately as possible. However, actual product appearance may vary depending on your device or display settings, and minor variations in color, texture, or finish do not constitute defects.
Product availability is subject to change without notice. We do not guarantee that any specific product will remain available at any given time.
5. Orders and Contract Formation
By placing an order, you make an offer to purchase the selected products under these Terms. You confirm that all information you provide is accurate and complete.
After your order has been placed, you will receive an order confirmation by email. This confirmation acknowledges receipt of your order but does not constitute acceptance. A binding contract is formed only when we confirm dispatch of your order or otherwise expressly accept it.
We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, product unavailability, delivery restrictions, or where fulfillment would violate applicable law. If we cancel an order for which payment has already been received, we will refund the full amount without undue delay.
6. Prices
All prices displayed on our website are shown in the selected currency and are inclusive of applicable taxes where relevant, unless otherwise stated. Shipping costs, customs duties, and import taxes are not included in the product price unless expressly indicated.
Prices may change without prior notice but will not affect orders that have already been confirmed.
7. Payments
Payments on our website are processed by Stripe Payments Europe, Ltd. Depending on your country and currency, different payment methods may be available, including bank cards and digital wallets supported by the payment provider.
We do not store your complete payment card information. Payment card details are transmitted directly to the payment provider via encrypted connection.
8. Shipping

Estimated delivery times are provided for reference only and may vary due to customs procedures, carrier delays, local holidays, or other circumstances beyond our control.
Customers are responsible for any customs duties, import taxes, or local fees required by their country of destination unless otherwise stated.
9. Right of Withdrawal (EU Consumers)
If you are a consumer resident in the European Union, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights.
To exercise this right, you must inform us of your decision to withdraw by a clear statement sent to info@fitpole-store.com before the 14-day period expires. Returned goods must be in their original condition, unused, and with all original packaging and tags intact.
You bear the direct cost of returning the goods. We will refund the amount paid for the returned products within 14 days of receiving them, using the same payment method used for the original transaction.
The right of withdrawal does not apply to certain categories of goods, including items made to your specifications, personalized products, or hygiene-sensitive items (such as underwear) once unsealed.

By placing an order, you represent that you are not located in, and are not ordering on behalf of any person located in, a jurisdiction subject to comprehensive international sanctions, and that you are not listed on any applicable sanctions list. We reserve the right to refuse or cancel any order that cannot lawfully be fulfilled under applicable sanctions regulations or export controls.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, war, acts of terrorism, government actions, epidemics, disruptions to transportation or postal services, or failures of third-party providers.
15. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this website or the purchase of our products. Our total liability in connection with any order shall not exceed the amount paid by you for the order in question.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable mandatory consumer protection law.

17. Governing Law and Jurisdiction
These Terms & Conditions and any contract formed under them shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania, without regard to its conflict of laws principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lithuania, unless mandatory consumer protection laws of your country of residence provide otherwise.
18. Dispute Resolution
If you are a consumer resident in the European Union, you may access the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are, however, not obliged and do not commit to participate in alternative dispute resolution proceedings before consumer arbitration bodies.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
